To the maximum extent permitted by applicable law, in no event shall we be liable for any damages whatsoever (including without limitation, direct or indirect damages for personal injury, loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if we have been advised of the possibility of such damages. In any case, our entire liability under any provision of this agreement shall be limited to the amount actually paid by you for access to this site, i.e. nothing. (3) Copyright protection All title and intellectual property rights in and to the site (including but not limited to any images, photographs, animations, video, audio, music, text and "applets," incorporated into the site), are owned by the authors. This site uses HTML code to display itself. You are permitted to have the following copies: (a) One copy in the computer's RAM (b) One copy in your browser's Internet cache, which you may only use whilst online. Net Cacheing services are also permitted to make one copy of the site on their server for cacheing purposes only. You are explicitly prohibited from: (a) making any copies, including saving pictures or text to media other than that mentioned above. (b) making any audio recordings of sounds found on this site. (c) making printed copies of any part of this site. Any copies accidentally produced must be immediately destroyed. (d) making back-up copies of the site. (e) quoting from the site, unless written, explicit prior permission has been obtained from the authors. (f) using any tool to download this site en masse, i.e. Teleport Pro. (g) attempting to FTP into the site (h) viewing directory structures within the site Unauthorised reproduction or distribution of any KHS data, including any portion of it, no matter how small, may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under the law. (4) Other people Each person who sees this site must individually agree to this EULA. You are prohibited from showing data from this site to any other person without them having individually agreed to this EULA. (5) Termination of License Due to the informational nature of this site, the license cannot be terminated. (6) Disassociation of authors from non-author-written-content Some parts of this site are not written by the authors of KHS. You are required to disassociate these from the authors. Any copyrighted material from other sources should be treated as such, and all applicable laws should be directed to the authors of said content - not us. (7) Limitations on Reverse Engineering, Decompilation and Disassembly You may view the source of this site, and may learn from it, but copying is prohibited. (8) Separation of Components. The site is licensed as a single product. Its component parts may not be separated. (9) Recognition of Free Speech (a) You are required to recognise the authors right to free speech and uphold this sentiment wherever possible. (b) You must also recongise that all characters and locations in this site are ficticious and any resemblence to persons, living, dead or otherwise is purely enigmatically coincidental, and at any rate, very subtle. (10) Permitted use of login keywords This site uses a security feature based around certain keywords. The authors of the site will reveal keywords to you when is appropriate. If you have been given a keyword, it is your responsibility to keep it a secret and to not disclose it to anybody else. If somebody other than us has told you a keyword, you are prohibited from using it without gaining explicit prior permission from the authors of this site. We reserve the right to deny access to anybody who misuses keywords as described above, or in any other way we find unacceptable. (11) Definition of Hacking The following activites are hacking and will be prosecuted accordingly: (a) Viewing any of this site without truthfully agreeing to this EULA. (b) Reversing javascript code with the intent of gaining further access to KHS data. (c) Attempting to view data protected by the 'Login' page. (d) Attempting to get around having to agree to this EULA. (12) Updates of this EULA When you agree to this EULA, it is up to you to check for new versions of this EULA. Failure to do so and the resulting "I didn't know" is no excuse. (13) Right to refuse contact We reserve the right to not communicate with you in any way, should you fail to comply to any part of this EULA after having agreed or viewed any section of this site. (14) Disclosure of the existence of this site If you choose to tell somebody that this site exists, you must make sure they individually agree to the EULA. You may BOTH be prosecuted if you do not. Please note that 'telling somebody' constitutes them finding the site as a result of you existing. This includes direct informing, allusion in other conversation, overhearing your conversations, subtle hints and writing down the URL in a place which it is possible for somebody to see. It also includes telephone calls, email, world wide web, irc, icq, telnet, messageboards, chat rooms or any other form of Internet Communication, or, indeed, communication in general. Theft of personal property containing or alluding to the existence of this site is NOT an acceptable excuse should somebody find out as a result of it - it is sensitive information and as such you are required to take extreme care of it. You are also strictly and explicitly prohibited from telling somebody about the site should you not agree to the EULA yourself. (15) Acknowledgement of Site Status (a) This site is in permanent Beta until it's release date. You are required to acknowledge that certain aspects of the site are liable to change, and that certain aspects may be partially wrong or completely wrong. We hold no responsibility for this. (b) This site is to be deemed art. Interpret it as you will, as we offer no explanation of the diverse and quite often esoteric nature of it's content. Make of it what you will and treat it the same way you would treat looking at a painting, reading a book or listening to music. (c) This site is officially registered as an Anarcho-Syndicalistic Collective, with the KHS Office of Registration, license #0031337. We hold no responsibility for the actions of this organisation. (16) Results of breaking the EULA You are required to recognise that should you break the EULA: (a) You may be charged with severe civil and criminal penalties. If the cost of damages exceed what you are able to pay, your home may be at risk. (b) Your job may be at risk, as few employers are willing to employ hackers and thieves. (c) We reserve the right to refer to you as "Liar", "Thief", "Criminal", "Scum", "Swine", "Robber", "Swindler", "Pirate", "Looter", "Hacker", "Falsifier", "Perjurer", "Prevaricator", "Deceiver", "Cheater", "Fraud", "Phradster" or "Intruder", or any combination, or all at once. (17) Quality Assurance For quality of service purposes we may occasionally monitor or record our lessons. If you are not entirely satisfied with this situation, please inform us in writing, signed by at least seven senior members of staff from your organisation. Please allow 6-8 months for a reply, the result of which may or may not be a formal inquiry into the circumstances.
